Terms of Service

By accessing or using Atlas Finance ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Service.

Atlas Finance is a personal finance management application that helps you:

• ●Connect and view your bank accounts and financial institutions via Plaid
• ●Track transactions, spending patterns, and recurring bills
• ●Monitor credit card rewards, loyalty programs, and card benefits
• ●Set and track financial goals and budgets
• ●View investment holdings and cryptocurrency balances
• ●Get AI-powered financial insights and answers to financial questions
• ●Track assets including vehicles and cryptocurrency
• ●Split expenses with other users
• ●Estimate tax deductions and manage tax-related data

To use the Service, you must create an account. You agree to:

• ●Provide accurate and complete registration information
• ●Maintain the security of your password and account
• ●Enable two-factor authentication for enhanced security (recommended)
• ●Notify us immediately of any unauthorized access
• ●Be at least 18 years of age
• ●Accept responsibility for all activities under your account
• ●Not share your account credentials with others

By connecting your financial accounts through Plaid, Coinbase, or other services, you:

• ●Authorize us to access your account information for display and analysis purposes
• ●Understand that we use read-only access and cannot initiate transactions or move money
• ●Acknowledge that data accuracy depends on your financial institutions and third-party providers
• ●Can disconnect accounts at any time through Settings
• ●Understand that Plaid's use of your data is also governed by Plaid's privacy policy

Atlas Finance includes AI-powered features. By using these features, you understand that:

• ●AI responses are generated by third-party AI models (Anthropic Claude) and may not always be accurate
• ●AI-generated content does not constitute financial, tax, legal, or investment advice
• ●Your questions and relevant financial context are sent to Anthropic for processing
• ●You should independently verify any AI-generated insights before making financial decisions
• ●Automated features (transaction categorization, bill detection, reward estimation) are best-effort and may contain errors

You retain ownership of all data you provide to the Service. By using Atlas Finance, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing and improving the Service. We do not claim ownership of your financial data, conversations, or any content you create within the Service.

You agree not to:

• ●Use the Service for any unlawful purpose
• ●Attempt to gain unauthorized access to our systems or other users' accounts
• ●Interfere with or disrupt the Service or its infrastructure
• ●Use automated systems, bots, or scrapers to access the Service without permission
• ●Reverse engineer, decompile, or attempt to extract source code
• ●Upload malicious files, viruses, or harmful content
• ●Use the Service to facilitate money laundering, fraud, or other financial crimes
• ●Circumvent rate limits or security measures
• ●Impersonate another person or misrepresent your identity

The Service and its original content, features, and functionality are owned by Atlas Finance and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our express written permission.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• ●The Service will be uninterrupted, error-free, or secure at all times
• ●Financial data will be 100% accurate or up-to-date at all times
• ●AI-generated content will be accurate, complete, or appropriate
• ●The Service will meet all your requirements
• ●Reward calculations, tax estimates, or bill detection will be error-free
• ●Third-party integrations (Plaid, Coinbase, etc.) will always be available

To the maximum extent permitted by law, Atlas Finance shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of the Service. This includes but is not limited to damages arising from:

• ●Inaccurate financial data or calculations
• ●Reliance on AI-generated insights or recommendations
• ●Service interruptions or data loss
• ●Unauthorized access to your account
• ●Actions taken based on information provided by the Service
• ●Third-party service outages or data inaccuracies

You agree to indemnify and hold harmless Atlas Finance and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

In the event of a dispute arising from your use of the Service:

• ●You agree to first attempt to resolve the dispute informally by contacting us at support@atlasfi.io
• ●If the dispute cannot be resolved informally within 30 days, either party may pursue binding arbitration
• ●Arbitration will be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA)
• ●You agree to waive any right to participate in a class action lawsuit or class-wide arbitration
• ●Small claims court actions are exempt from this arbitration provision

We may terminate or suspend your account at any time for violations of these Terms, fraudulent activity, or for any other reason at our discretion with notice. You may delete your account at any time through Settings. Upon termination, your right to use the Service will immediately cease and your data will be deleted in accordance with our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page, updating the "Last updated" date, and sending an email notification for significant changes. Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in California.
